Built from real cases seen in construction litigation, it breaks down three contract “ingredients” that get misunderstood the most: disclosures and disclaimers (what must be said and what is not the contractor’s responsibility), attorney’s fees provisions (so legal costs do not come out of pocket when rights have to be enforced), and indemnification language (smart risk transfer without signing into uninsured exposure). A major theme throughout is pass down liability, making sure obligations in the customer contract are mirrored in subcontract agreements so the right party owns the right risk.
