In April 2024, the Federal Trade Commission released new guidance changing the landscape of non-compete provisions in the United States. Being federal, contractors in all 50 states are affected and should understand the implications of the FTC's final rule on their business and misconceptions spreading in the construction community about the scope of this rule. All past and future non-competes have not now been banned as a result of this rule, and nuances exist that are important. For example, a carve out exists for senior executives under existing non-competes who meet certain criteria. Another exception applies when a person sells their shares in a business and signs a non-compete as part of the sale. This course addresses non-competes historically and the new rule, current challenges to the rule, and bridges the gap between falsities and reality to paint an accurate picture of who is impacted by this rule and how it will take shape
